Age Verification Information

Because we sell alcoholic beverages, we ask you to confirm that you meet the legal drinking age in your country and at the place of delivery, via our website's age gate and/or at checkout. This is a self-declared confirmation — we do not collect or store your date of birth.

Our delivery partner may independently check identification at the point of delivery to confirm the legal age requirement is met. This check is carried out by the delivery partner directly; we do not receive or retain a copy of any identification shown at that point.

This is collected specifically to comply with Swiss alcohol-sales law (Federal Law on Foodstuffs and Utility Articles, LMG, SR 817.0) and applicable cantonal regulations. See Section 3 for more detail.

We do not knowingly collect personal information from individuals who have not reached the legal age required to purchase alcoholic beverages in their country and at the place of delivery.

These Terms of Service ("Terms") govern your access to and use of elliots.ch (the "Website") and all related services provided by Monnet Wine, trading as Elliot's Keller ("Elliot's Keller," "we," "us," or "our"). By accessing the Website, creating an account, placing an order, or using any of our services, you agree to be bound by these Terms.

Article 1 — About Us

Article 2 — Scope

These Terms apply to all visitors, registered accounts, online purchases, wine tastings, private and corporate events, wine tours, and all other services offered through the Website. Conflicting terms proposed by a customer apply only if expressly accepted by us in writing.

Article 3 — Eligibility and Legal Drinking Age

By using the Website or placing an order, you confirm you've reached the legal age to purchase alcoholic beverages in your country and at the place of delivery, that your checkout information is accurate, and that you're legally entitled to purchase alcohol.

We may verify the recipient's age before or upon delivery. If satisfactory proof can't be provided, we may refuse delivery or collection, cancel the order, and refund it after deducting any non-recoverable delivery or administrative costs where permitted by law.

Article 4 — Products

We specialise in carefully selected wines from independent growers and wineries. As an agricultural product, natural variation between vintages, labels, bottle appearance, capsule colour, and closures is normal and not a defect. Product photos are illustrative only; slight differences from the delivered product aren't grounds for cancellation or refund provided the correct wine is supplied. We may limit quantities, discontinue products, modify descriptions, correct errors, or substitute packaging without altering the product. Displayed availability is indicative, not guaranteed.

Article 5 — Orders

An order is an offer to purchase and becomes binding only once accepted by us. An automatic acknowledgement email confirms receipt, not acceptance. We may refuse or cancel an order for unavailability, pricing errors, suspected fraud, unverifiable payment, legal restrictions, or failed age verification. Refunds for cancelled paid orders go to the original payment method.

Article 6 — Prices

Prices are in CHF and, unless stated otherwise, include applicable Swiss VAT. Shipping charges are shown at checkout. If a pricing error occurs, we may contact you before dispatch, cancel the order, or refund in full. Price changes don't affect orders already accepted.

Article 7 — Payment

We accept the payment methods shown at checkout, including eligible credit/debit cards, TWINT, bank transfer, and other methods offered through Shopify Payments or approved providers. Payment must be authorised before dispatch. For bank transfers, instructions must be followed within two business days; unpaid orders may be cancelled. Goods remain our property until paid in full.

Article 8 — Delivery

Delivery methods, areas, fees, and estimated times are set out in our Shipping Policy. Estimates are indicative, not guaranteed. Delays from carriers, weather, customs, strikes, or force majeure aren't grounds for cancellation or compensation. Risk passes to you on successful delivery. If delivery fails due to recipient absence, incorrect address, failed age verification, or refusal, additional charges may apply.

Article 9 — Inspection of Goods and Claims

Inspect your order promptly. Report damaged, missing, or incorrect items to emeric@elliots.ch within 24 hours of receipt, ideally with photos of the parcel, the goods, and the shipping label. Late notification may affect our ability to investigate. Where the issue is our error or transport damage, we'll replace, refund, or offer another solution at our discretion. This Article doesn't affect mandatory rights under applicable law.

Article 10 — Returns and Refunds

Swiss law provides no statutory right of withdrawal for online purchases; orders are final once accepted and paid. Full detail on damaged, missing, incorrect, or faulty items, and on what can't be returned, is set out in our Return and Refund Policy, which forms an integral part of these Terms. For tastings and events, see Article 11; for wine tours, see Article 12.

Article 11 — Wine Tastings and Events

Registration becomes binding once payment is received. Cancellations must be requested in writing by email.

More than 14 days before the event, you may choose: a full refund; transfer to another event of equal value, subject to availability; or transfer of the booking to another participant, subject to our approval.

Between 14 days and 72 hours before the event, you may choose: transfer to another event of equal value, subject to availability; a full refund if your place is successfully resold from the waiting list; or transfer of the booking to another participant, subject to our approval.

Less than 72 hours before the event, or no-show: no refund, transfer, or credit.

If we cancel due to insufficient registrations, venue issues, or other circumstances within our control, you'll be offered a full refund or transfer to another event. Refunds are processed to the original payment method within 5–10 business days.

Article 12 — Wine Tours

Our wine tours involve third-party commitments — accommodation, transport, and host venues — that are typically non-refundable once booked on your behalf. Cancellations must be requested in writing by email.

More than 60 days before departure: full refund, minus a non-refundable booking deposit of 20% of the trip price, reflecting costs already committed to hosts and suppliers.

Between 30 and 60 days before departure: 50% refund.

Less than 30 days before departure, or no-show: no refund.

At our discretion, a transfer to another participant (subject to our approval) or to another departure date (subject to availability) may be offered instead of a refund.

If we cancel a tour — due to insufficient participation, a host's unavailability, or other circumstances within our control — you may choose a full refund or a transfer to another date.

Article 13 — Customer Accounts

You're responsible for keeping your login credentials confidential, restricting account access, and keeping your information accurate. You're responsible for all activity on your account. We may suspend or terminate accounts for suspected fraud, abuse, or unlawful activity.

Article 14 — Intellectual Property

All content on the Website — trademarks, logos, text, photographs, graphics, illustrations, videos, product descriptions, tasting notes, branding, design, software, and databases — is the property of Monnet Wine, trading as Elliot's Keller, its licensors, or respective rights holders, protected under Swiss and international intellectual property law. No content may be copied, reproduced, distributed, modified, republished, or commercially exploited without our prior written permission. You may access the Website for personal, non-commercial use only.

Article 15 — Website Use

You agree to use the Website lawfully. You must not misuse it, interfere with its operation, attempt unauthorised access, upload malicious software, transmit viruses, circumvent security, engage in fraud, impersonate others, or otherwise breach applicable law. We may suspend or block access for violations.

Article 16 — Third-Party Services and Links

The Website may link to third-party sites, payment providers, social platforms, or external services operated independently of us. We don't control and aren't responsible for their content, privacy practices, availability, or products. Your use of them is governed by their own terms.

Article 17 — Relationship with Shopify

Our Website and related order-processing, payment, and hosting infrastructure are powered by Shopify. Notwithstanding this, any purchase made through the Website is concluded directly and exclusively between you and Monnet Wine, trading as Elliot's Keller. Shopify is not a party to that transaction and bears no responsibility for it, including for any injury, damage, or loss arising from products or services purchased through the Website. Any claim relating to your purchase should be directed to us, not to Shopify.

Article 18 — Feedback

If you voluntarily submit comments, suggestions, reviews, or other feedback, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, adapt, and display it to improve or promote our business. You confirm your feedback is truthful, doesn't infringe third-party rights, and isn't defamatory or unlawful. We're not obliged to publish, compensate, or respond to it.

Article 19 — Errors and Corrections

The Website may occasionally contain typographical errors, inaccuracies, or omissions relating to pricing, availability, descriptions, images, promotions, or specifications. We may correct these, update information, withdraw products, or cancel affected orders at any time without prior notice. Amounts already paid for orders that can't reasonably be fulfilled will be refunded in full.

Article 20 — Force Majeure

Neither party is liable for failure or delay caused by events beyond reasonable control — natural disasters, fire, flooding, severe weather, epidemics, war, terrorism, civil unrest, strikes, transport interruptions, supply chain disruption, governmental restrictions, or telecommunications/power failures. We'll inform affected customers where reasonably possible and minimise disruption. Where performance becomes impossible for an extended period, either party may cancel the affected order or booking without further liability, subject to mandatory law.

Article 21 — Warranties and Limitation of Liability

We take reasonable care to keep Website information accurate and up to date. Except where mandatory law provides otherwise, the Website is provided on an "as available" basis, without guarantee of uninterrupted or error-free operation, and product availability may change without notice.

To the fullest extent permitted by Swiss law, we're not liable for indirect or consequential damages — loss of profits, revenue, business opportunity, data, or reputational damage.

Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, death or personal injury where liability cannot legally be excluded, or any liability that cannot be limited under mandatory Swiss law.

Wine is a natural agricultural product; variations between bottles, vintages, labels, closures, packaging, or sensory characteristics aren't defects where the wine supplied matches the description and product purchased. Product photographs are illustrative only.

Article 22 — Privacy and Personal Data

The collection and processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Website, you acknowledge we may process personal information to fulfil orders, verify age where legally required, process payments, arrange deliveries, provide support, comply with legal obligations, and improve our services. We use cookies to operate the Website, remember preferences, improve functionality, and analyse traffic; non-essential cookies are used only after obtaining your consent where required by law.

Article 23 — Intellectual Property Complaints

If you believe content on the Website infringes your intellectual property rights, contact us with your details, identification of the protected work and the allegedly infringing material, and evidence of your ownership or authority. We'll investigate legitimate requests and, where appropriate, remove or restrict access to the relevant content.

Article 24 — Severability

If a provision of these Terms is found unlawful, invalid, or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions stay in full force.

Article 25 — Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, Legal Notice, and any other policy referenced on the Website, form the entire agreement between us regarding use of the Website and Services. No oral representation or prior communication modifies these Terms unless confirmed in writing.

Article 26 — Governing Law and Jurisdiction

These Terms are governed exclusively by Swiss law. Subject to mandatory consumer-protection provisions, the exclusive place of jurisdiction is Zurich, Switzerland. Nothing here limits rights consumers have under mandatory applicable law.

Article 27 — Changes to These Terms

We may amend these Terms at any time; the most recent version is always published here with its "Last Updated" date. Changes take effect on publication unless applicable law requires otherwise. Continued use after publication constitutes acceptance.

Final Provision. By accessing the Website, placing an order, attending an event, or otherwise using our Services, you acknowledge that you've read, understood, and agreed to these Terms, which aim to provide a fair, transparent framework while preserving all mandatory rights under Swiss law.

Shipping policy

At Monnet Wine, trading as Elliot's Keller, we believe every bottle should arrive in the same condition in which it left our cellar.

We therefore use carefully selected packaging materials and trusted delivery partners to ensure your wines are transported safely and efficiently.

This Shipping Policy forms an integral part of our Terms of Service.


1. Delivery Area

We currently deliver within Switzerland.

International shipping is not currently offered.

Should additional countries become available in the future, they will be published on the Website.


2. Order Processing

Orders are prepared after successful payment.

Orders are generally processed within:

1–3 business days

during normal business operations.

Orders placed during weekends, Swiss public holidays or company closures are processed on the next available business day.

While we always aim to dispatch orders promptly, processing times are estimates and may occasionally vary during peak periods.


3. Delivery

Once your order has been dispatched, delivery is normally completed within the estimated timeframe displayed during checkout.

Delivery is performed by our selected logistics partner. Where electric vehicle delivery is selected within the Canton of Zurich, see Section 10.

Estimated delivery times are indicative only and are not guaranteed.

Delays caused by transport providers, weather conditions, customs procedures, traffic disruptions, force majeure or circumstances beyond our reasonable control do not entitle customers to compensation or cancellation.


4. Shipping Costs

Shipping costs are displayed during checkout before payment.

Where applicable, free shipping promotions or minimum order thresholds are clearly indicated on the Website.

Any applicable shipping charges are calculated before the order is confirmed.


5. Packaging

Every order is packed using protective packaging specifically designed for transporting wine.

Depending on the season and destination, packaging may include insulated or reinforced materials to reduce the risk of damage during transport.

We continuously seek environmentally responsible packaging solutions while ensuring the safe transport of our wines.


6. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If an incorrect or incomplete address is provided, delivery delays or additional shipping costs may occur.

Where a shipment is returned because of incorrect delivery information supplied by the customer, any additional shipping costs may be charged before the order is resent.


7. Age Verification

By placing an order, you confirm that you have reached the legal age required to purchase alcoholic beverages in your country and at the place of delivery.

To comply with applicable legislation relating to the sale of alcoholic beverages, we reserve the right to verify the recipient's age before or upon delivery.

If satisfactory proof of legal age cannot be provided, we reserve the right to:

  • refuse delivery;
  • refuse collection;
  • return the shipment;
  • cancel the order where appropriate.

Any refund issued in such circumstances may be reduced by any non-recoverable shipping or administrative costs where permitted by applicable law.


8. Failed Delivery

A delivery may be considered unsuccessful if:

  • the recipient is unavailable;
  • the delivery address is incorrect;
  • access to the delivery location cannot reasonably be obtained;
  • age verification cannot be completed;
  • delivery is refused.

Additional delivery attempts or re-delivery charges may apply depending on the transport provider.


9. Collection (Click & Collect)

Where this option is offered during checkout, customers may choose to collect their order directly from Elliot's Keller.

Collection is available by appointment only after confirmation that the order is ready.

Orders should be collected within the agreed collection period.

If an order remains uncollected for an extended period without prior arrangement, we reserve the right to cancel the order and issue a refund after deduction of any reasonable administrative costs where permitted by law.


10. Zurich Canton E-Vehicle Delivery

Where available, orders may be delivered by electric vehicle within the Canton of Zurich, at a selected time slot chosen during checkout.

This service is offered as an alternative to standard delivery and is subject to availability.

If a delivery cannot be completed because the recipient is unavailable at the selected time slot, a missed-delivery fee may apply, as displayed during checkout.


11. Transfer of Risk

Risk of accidental loss or damage passes to the customer upon successful delivery to the delivery address or upon collection of the order.

Ownership of the goods remains with Elliot's Keller until full payment has been received.


12. Damaged Deliveries

Customers should inspect their shipment immediately upon delivery.

Any damage, missing products or incorrect items must be reported within 24 hours of receipt.

Whenever possible, please provide:

  • your order number;
  • photographs of the parcel;
  • photographs of the damaged products;
  • photographs of the shipping label.

Our Return & Refund Policy explains how such claims are handled.


13. Force Majeure

Delivery schedules may be affected by circumstances beyond our reasonable control, including:

  • severe weather;
  • transport disruptions;
  • strikes;
  • natural disasters;
  • governmental restrictions;
  • public emergencies;
  • supply chain interruptions.

We are not responsible for delays resulting from such events, although we will make reasonable efforts to keep customers informed.

Returns & refunds

Elliot's Keller takes great care in selecting and storing the wines we sell. As a Swiss retailer, Swiss law does not provide a statutory right of withdrawal for online purchases — orders are final once payment is validated. Within that, here's how we handle issues:

Damaged, missing, or incorrect items Please inspect your order on arrival. Contact us at emeric@elliots.ch within 24 hours of receipt if the package or a bottle arrived damaged, an item is missing, or you received the wrong item. Where possible, include photos of the parcel, the damaged goods, and the shipping label. Claims made after this window may be harder for us to investigate.

Where the issue is our error or transport damage, we'll — at our discretion — replace the item, refund it, or offer another suitable solution. All reasonable costs of correcting our error are on us.

Faulty wine Wine is a natural product, and occasional bottle faults (such as cork taint) can happen. Contact us before disposing of a bottle you believe is faulty. To assess the claim, we may ask that the bottle be at least two-thirds full, include the original cork or closure, and be returned to us for inspection. Where a genuine fault is confirmed, we'll replace the bottle or refund you if a replacement isn't available.

What we can't replace or refund

  • Wines you simply didn't enjoy — personal taste, or characteristics typical of the wine's style, grape variety, terroir, or vintage — even unopened.
  • Normal variation between vintages, and superficial label, capsule, or packaging wear. This doesn't affect what's in the bottle, and product photos on the site are illustrative, not contractual.
  • Opened bottles, beyond a verified faulty-wine claim above.
  • Sale items, gift cards, and digital gift certificates.
